The purpose of this Privacy Policy is to explain the rules on which your personal data is processed and to discuss your basic rights with the processing of your personal data by, respectively, CNKP Legal Piela Kowalski i Partnerzy Kancelaria Radców Prawnych, Tax Advisors and Statutory Auditors, CNKP Tax & Accounting limited liability company or CNKP Audyt limited liability company.

Personal data controller

The administrator of your personal data is, respectively, depending on the services of which entity you use:

jointly referred to as the CNKP.

Your personal data collected by CNKP are processed on the terms specified in the provisions on the protection of personal data, including in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing the Directive 95/46 / EC (general regulation on data protection), hereinafter referred to as the GDPR, and in the provisions of Polish law, including in particular the Act of May 10, 2018 on the protection of personal data. Your personal data is treated confidentially by CNKP and protected against unauthorized access by third parties on the terms specified in the above-mentioned legal acts.

The scope and purposes of personal data processing

As part of its activities, CNKP collects and processes your personal data:

  • in order to perform a contract concluded with you, as a natural person, the subject of which is, respectively: the provision of legal assistance, accounting services or financial audit services or to meet your request submitted before the conclusion of the contract for the provision of legal aid, for the provision of accounting services or for the provision of financial audit services, e.g. for the estimation of working time and / or remuneration of  CNKP - pursuant to art. 6 sec. 1 lit. b GDPR,
  • in order to perform contracts concluded with customers, other than the contracts referred to in the above indent, including the organization of training - pursuant to Art. 6 sec. 1 lit. b GDPR,
  • in order to cooperate with suppliers and other cooperating entities - pursuant to art. 6 sec. 1 lit. b GDPR,
  • in order to fulfil the legal obligations incumbent on CNKP, including in particular the settlement of CNKP remuneration for the provision of legal assistance, accounting services or financial audit services and other payments in connection with the provisions of tax law and accounting - pursuant to art. 6 sec. 1 lit. c GDPR,
  • in order to perform the contract concluded with the client / contractor with whom you are employed, regardless of the legal basis of employment - pursuant to art. 6 sec. 1 lit. f GDPR, however, the legitimate interest of CNKP is in this case to establish and maintain contact with the client / contractor and to perform the contract concluded with him for the provision of legal assistance, accounting services or financial audit services (in the case of a customer) or another (in the case of a contractor - an entity for which we do not provide services),
  • in order to answer your inquiry, provide information or establish contact with you - pursuant to art. 6 sec. 1 lit. f GDPR, however, the legitimate interest of CNKP consists in the possibility of responding to the questions addressed to CNKP and the possibility of contacting you,
  • in order to pursue claims under a contract between us and you, the subject of which is the provision of legal assistance, accounting services or financial audit services - pursuant to art. 6 sec. 1 lit. f or art. 9 sec. 2 lit. f GDPR,
  • in order to inform you about events organized by CNKP or in which CNKP participates and about the activities of CNKP (especially as part of the newsletter), as well as for analytical and statistical purposes and to ensure ICT security related to the cnkp.pl website - pursuant to art. 6 sec. 1 lit. f GDPR.

Your rights

Your personal data is processed on a voluntary basis, however, depending on the circumstances, a refusal to provide CNKP with your personal data or a request to remove them may prevent CNKP from contacting you, responding to your inquiry, providing you with information about events and / or activities of CNKP, as well as, above all, the provision of a service to you. The processing of your personal data in connection with the provision of legal assistance, accounting or financial audit services by CNKP to you is covered by the provisions of the, concluded with you, agreements or general terms and conditions relating to the provision of given services, used by CNKP. Sending you the newsletter depends on your consent, given by subscribing to it.

Moreover, you are entitled to:

  • the right to access your personal data,
  • the right to rectify your personal data,
  • the right to delete or limit the processing of your personal data, and
  • the right to transfer your personal data.

Please note, however, that some of the above-mentioned rights may not be available to you in the processing of your personal data as part of the provision of services by CNKP.

If you do not want CNKP to process your personal data for marketing purposes, you may at any time object to the processing of your personal data for this purpose. Moreover, if you have given your consent to the processing of personal data, you can withdraw it at any time, however, the withdrawal of consent will not affect the processing of data that took place before its withdrawal.

Right to lodge a complaint

In connection with the processing of your personal data by CNKP, you have the right to lodge a complaint with the President of the Office for Personal Data Protection.

Processing period

Your personal data will be processed by CNKP, respectively:

  • until the expiry of the limitation periods related to the contract with which the processing of your personal data is related,
  • until the expiry of the limitation periods for obligations under the law,
  • until CNKP, as the data controller, realises the relevant legitimate interests related to the processing of your personal data,
  • until you object to the processing of your personal data for marketing purposes (e.g. newsletter).

Transferring personal data to other entities

The recipients of your personal data may be, in particular, entities related directly or indirectly to CNKP, based in Poland, as well as external service providers for CNKP (e.g. entities providing IT services, including cloud computing services), administration bodies, state services and courts.

Your personal data is processed at the headquarters of CNKP and is not transferred to countries outside the European Union. In the event of transfer of personal data to third countries outside the European Union, CNKP will use appropriate instruments to ensure the security of your personal data.

Automated personal data processing / profiling

Your personal data is not processed in an automated manner, including in particular, they are not subject to profiling.

Changes to the Privacy Policy

Any changes to the Privacy Policy will be published on the cnkp.pl website and will be valid only for the future. The changes to the Privacy Policy introduced by CNKP will enter into force after you accept the amended Privacy Policy, about which you will be notified in a pop-up window.
